It is of course illegal to have sex with anyone under 16.
But what would the police actually do about it? 16 and 14, they consented, they're close in age, it wasn't bothering anyone else... in a case like that, official guidance to the police is to leave well alone. Is it really in the public interest to take this boy to court and have him imprisoned and put on the sex offender register for something they could have done legally a year or two later? Is it going to make the law look totally daft if the Crown Prosecution Service go for a prosecution?
When the CPS definitely will go for a prosecution is if she is under 13. The law states that at that age, she is not ABLE to consent, therefore it is unlawful sex whatever she says.
The age of consent is 16. It is illegal for ANYBODY to have sex with someone under 16 years of age. But there is a defence available which may reduce the sentence if the judge believes it:
If the accused person took all resonable care to establish that the young person was actually aged 16 or over before having sex, this can be mitigation.
Sexual activity with someone 13 or under is absolutely illegal regardless of any efforts to establish their age, and consent cannot be given by the child under any circumstances.
The maximum sentence for somebody over 18 having sex with someone between 13 and 15 years old is 14 years.
The maximum sentence for someone under 18 for having sex with an underage person is 5 years.

No one under the age of 16 yrs old can consent, because they are a child, so the other older 'partner' would get arrested and charged with raping a minor
He will go to jail. Sentencing will likely be more lenient than it would be on a 38 year old, but he will still go to jail.

A child cannot give consent. If you have sex with an underage child you will be breaking the law. You can end up on the sex offenders register.
We do not have an offence of statutory rape in the UK, it is underage sex.

Men have been convicted and put on the register for unknowingly sleeping with an underage girl. At the point you know, you have no excuse whatsoever.
The law would probably ignore it - unless the 14 year old, or his/her parents, made a formal complaint.
A14 year old cannot consent. It would be rape and an offence against a child.
