#1 Pay the monthly rent to include any late fees immediately
#2. If you are unable to pay the monthly rent and late fees, you are required to move immediately or at least during the 3 day period.
The notice you received was to inform you to take action of some type. Failure of you to take any action would cause your landlord to take additional legal action.
If you take action and do one of the two mentioned above, there would be no further action taken against you.
Failure on your part to move if you are unable to pay the rent and any late fees would be reason for your landlord to file for a legal eviction in a court, and signed by a judge.
I hope this has been of some benefit to you, good luck.
"FIGHT ON"
Go and try to pay it. Go first thing on Monday morning. Except some sort of conversation that may be uncomfortable about why you are late and how unhappy they are. I would then start planning for November to get rent on time. Where I live we have a three day grace period before it's considered late. Usually they won't give the three day notice until the 10th.
Try to pay the rent. If they take it (assuming it says rent is the reason you have to leave), then you are good. But have them put it in writing.
If they refuse it, then start looking for a new place to live. SOmething you can afford so you wont' be late on your rent.
Understand, when you are late, you are screwing over the landlord who still has to pay their bills on time. When you don't pay your bills, you leave them struggling. Unless it's a big corporation, that's a real problem.
A "3-day notice to pay or quit" is generally a "warning" that you might be subject to a lawsuit if you do not either quickly pay or quickly move out. You cannot be legally FORCED to move until the notice period has expired, you have still not paid, they have filed for an eviction order in the local court, there has been a hearing, you lose your case, you still haven't paid rent, you are served with a writ of possession by the sheriff, you are given anywhere up to a few days to get out, and then you are physically picked up and carried outside. Actual procedures and rules vary from one court to another. You might have a few weeks, you might have a month or two, or you might get the entire thing nipped in the bud if you pay on the next business day their office is open (and get a written receipt).
They might, but if you are late all the time they will tire of you quickly. Today is the 11th that is very very late and if you have been getting later and later it wouldn't be long before you were an entire month late. Most landlords have mortgages due on the first so you being late puts them out money to support you. If they give you a break vow not to do this again or you will be gone.
Try to pay it. If they refuse, start packing.
The three day notice is a legal pre-requisite the landlord must offer before they can file for an eviction. If you leave before the three days you can avoid the eviction all together but will likely still be on the hook to the landlord for unpaid rent/fees which they can sue you for later. Avoid formal eviction at all costs.
If they accept your payment they cannot file make a valid claim for eviction and you are safe at least until rent is due the next month.
Ok thank u but they gave it to me today and they don't open till Monday I have my money order with my late rent n the late fee. I'm hoping he can give me another chance
A 3-day notice is the first step in formal eviction proceedings. The exact procedure varies by state.
If you pay all back rent and late fees within the three day, they MUST accept you payment.
If you have the money, pay it. They are probably tired of getting rent late, start paying it on time.
Hi I live in Ohio I been late on my rent very recent months but today I received a three day notice to leave the premises I have the rent and late payment I just don't know if they a re gonna take my late rent what should I do I
That would be up to the landlord. Ask him.
Call the people. They may let you.
