I'm glad I researched quickly before posting. In NJ, if your rental agreement doesn't require the landlord to have a key, you can change the locks and not give him one. http://www.nj.gov/dca/divisions/codes/pu...

But, the second the LL realizes you have changed the locks, expect to get a request to sign a rental agreement or vacate.

check with your municipality tenant/landlord rules or bylaws. However, where I am from the landlord needs to give 24 hours notice before gaining entry into a tenant home. The exception is if there is an emergency in the home- ie. fire, flooding etc. where immediate access is needed.

There were some times where I had a landlord give me less than 24 hrs for rental viewing (for potential renters), however, they always asked my permission prior to coming first & I agreed. Those were few unusual circumstances.

Check with your rental rules- sometimes you cannot change the locks as you don't own the property- you rent it. At least where I am from, I had to look into that. Any alterations to the landlord's property permission has to be verified before making changes.

A landlord needs to give advanced notice before entering your apartment, unless there is an emergency....fire or flood. You have an expectation of privacy. I would change the locks or I would move.

You can not change the locks without landlord approval and giving him a new key. He is suppose to give you 24 hour notice prior to inspection unless it is an emergency situation. There is no civil law or enforcement of his violation. Send him a letter quoting the rental code and explain you will hold him liable for any missing items if he fails to comply. Keep a copy of letter for future reference. Good Luck

you do have a contract..paying money for a place to live...landlord needs to follow rules and laws...that means they cannot enter EVER without a legitimite reason, and withproper notice...notice for emergencies means they leave a note that they have been there...file a rent escrow action with the court...file a restraining order with the cops...if it is a manager and not the owner, should get them fired

I rent an apartment with no lease or contract. My landlord thinks it is ok to come in my apartment for any reason when I am not home. Is that legal? Can I change the locks since there is no lease that says otherwise? I live in NJ.
