I would not think so no. Typically when a tenant is evicted for non-payment all occupants are evicted as well. And I would not count on any favor from the landlord either. You admit to being an illegal unauthorized occupant. That does not get you any rights to the unit if anything it gets you evicted.

You are the one breaking laws here. I am baffled how you think you have any rights to this apartment what so ever.

You could possibly remain and take over as the leased tenant, but once Mom defaults, it is completely up to the landlord who takes her place and you would therefor need to qualify as a tenant like anyone else. But if your really want to stay, its in your best interest to not let Mom default on the lease.

Depends on the judge - most lean towards the occupant unless it is obvious that it is fraudulent: you've all but admitted that it is.

Go tell management what your plans are. If they feel they would rather have you as a tenant, then your in.

I lived my whole life in this rent stabilized apartment, if the reason my mom(the lease holder) gets evicted is because she couldn't pay the rent could I still succeed it?

My mom doesn't live in the apartment but is hiding it from the management, they know she doesn't live there but can't prove it other than with statements from the doormen saying they never see her.

Will the judge side with her or the management, in your honest opinion and can I still succeed it if its unpaid rent related.

P.S. I can pay for it but I need the apartment in my name so I can write checks to the management cause they don't accept ones in my name.
