When it comes to a lease there is NO primary or secondary. You are each 100% responsible for the rent and damages to the rental unit caused by any of you or any of your guests.

Your lease is a binding contract between party A (the landlord) and party B (you and your roommate). In order for any changes to that contract to take place all three of you have to agree. Will the landlord let your roommate out of her lease? Does she agree to leave? You have no control over the answers to these questions.

The only one who can make someone move if they refuse to leave on their own is a judge. Any one who refuses to leave once legal residence has been established (she signed the lease) has to be formally evicted through the courts. Who pays for, or doesn't pay for, what is irrelevant.

I suggest you have a talk with your roommate telling him that things aren't working out. He may agree with you.

You can't just kick him out. Go talk to the manager of the apartment complex to find out what the local rules are for eviction. He has just as much right to be there as you.

Worst case, find out what the penalty is for breaking your lease and move out if you can handle the cost. Again though, work with the manager to see what can be done legally.

I'm pretty sure you can. Just don't do it by force. And either say that he can pay more utilities, or leave.

so ive been living with this person in Nebraska for a few months now and we have a year lease, i am the primary and he is secondary. i pay for electricity, internet, food, supplies and half the rent. is there any ways for me to legaly remove him from the apartment.

some consistant problems, every morning leaving a fresh steamer in the toilet without flushing for when i get home from work. eating my food, taking over no responsibilities from the house (ie dishes trash,ect) his room makes the entire house smell of literal dog fecies and yet we dont have animals, and also being overly loud in the midst of night yet the neighbors dont complaign.
