Can my landlord do this?

Sorry, probably completely legal (depends upon your state and county). You have no lease. Month to month means just that - the terms of your else (and your lease itself) are only "fixed" for 30 days. This works both ways - landlords like to have tenants for a known time…a month to month allows the tenant to leave on 30 days notice, so they don't have that confidence in continued rent. You could re-enter into a long term lease and make sure water is included in rent.

Perfectly legal. Since you do not have a year lease, the landlord can change the method of billing you for expenses. Or, if you don't want to pay the water, the landlord can just estimate how much water you use and raise the rent that much (and he can always estimate high...like tack on an extra $100 even if you use $10 worth of water). As long as you are given 30 days notice, all legal. And you are not being discriminated against since by law the landlord cannot change the terms of the folks with leases until the lease expires (which he has already said he will do upon expiration).,

Those with a lease are protected from changes like this until their lease expires. The landlord cannot legally do this to them (he can meter the apartment, but he can't charge for the water differently than the lease allows). You chose to not re-lease and opted for the flexibility of a month-to-month. Nothing wrong with that at all, but you are only protected from changes for 30 days at a time.

Nice thing is that you can give 30 days notice to the landlord and leave, so you don't have to pay this, for very long anyway. You have that flexibility in your decision making.

How is that discrimination? The LL can change the terms of the lease when it is time to renew. He can change the terms of a month to month agreement with just 30 days notice.

Even if you sign a new lease, you will be paying for your water usage. THAT is what that notice said.

100% legal and not discriminatory at all. Everyone's lease will eventually end, and those that renew, along with future tenants with brand new leases will have this new bill written in them. Since you don't have a lease, you just start getting the bill sooner.

That is perfectly legal under a month to month agreement. This is why it's good to have a fixed term lease.

I did that in my units,,

A) Its legal

B) Those who wanted to fight about it had rents raised to cover the costs, Approx $50 a month.

C) Water and sewer bills run $20-25 a month in my area per unit.

D) Do you want to be "Right" or Happy?

Don't like it, then get a lease don't want one. Suck it up butter cup!!!

You have not too many rights especially when you don't have a lease!!

Your best opinion would be to fight him in court.

I am no longer in a lease after my 1 year lease agreement and now I get this. Do they have the right to do this? It really pisses me off because the landlord said it would be fine after one year to not release and just do month to month. They have tried to get us to release and I explained I did not want to because of said reason. Now this below is what I received and I did not have to pay water before.

Discrimination for those not bound by a lease? Seems unfair.

Dear Residents,

Please be advised the property owner is having the water sub-metered to all of his buildings. If you are month-to-month or your lease is expiring, you will begin receiving bills for your water usage.
