In an HMO the tenant/licensee occupies only part of the property and is only liable for rent for the part they occupy. An example would be where the tenant is liable for rent on an individual room basis and shares a bathroom and toilet with other tenants. The council makes the decision about a property’s designation as an HMO and the landlord is liable for paying the tax. The landlord can appeal the decision to the Valuation Tribunal, which is an independent body.
AND THE LANDLORD CANNOT ADD IT INTO YOUR RENT.
Captain above is joking, no landlord in the UK is dumb enough or rich enough to pay council tax on behalf of his tenants. Why don't you simply phone your local council to get it straight from the horse's mouth instead of reading conflicting advice here?
If the house is let on a rooms basis then it is what is called an HMO and as such the landlord is responsible for the council tax.
You need to speak to the local authority to find out
A) is the property a registered HMO
B) is it properly licenced as such
C) who is the named person on the council tax account.
If you are in an HMO you have no liability for council tax student or not.
The resident is responsible for paying the council tax not the landlord. The landlord is only responsible if he lives in the house too. Most students are exempt from paying council tax so you have to pay what is due. The council tax is much higher for a 4 bedroom house than it would be for a 2 bedroom house so if you want to pay less either get someone else to share with you and spread the cost or move to a smaller house with a lower council tax bill.
Even though we share the living room kitchen bathroom etc? the house isn't like split into flats it is a normal house but only occupied by me and a student with the other 2 rooms empty. So you think I shouldn't pay anything in this situation?

I am currently living in a shared house with one student. This is a four bedroom house so 2 of the bedrooms are empty. My landlord is saying I have to pay the full single occupancy council tax amount (75%).
Is this right as if she had rented the other 2 rooms out I would be paying alot less so should be covering the other 2 persons amount?
In my head single occupancy is when you rent the whole house but obviously I am rented my room and use of the kitchen, living room, bathroom etc... but the other 2 rooms i dont rent.
