First, you don't generally sue someone unless you have first tried to work things out.

Second, you cannot be charged your full rent if you are not getting the full "quiet enjoyment" of your premises.

Contact the landlord and ask for return of, say, half of the rent you paid for any month in which they allowed your rights to be violated by their lack of respect for your privacy or other obligations they owe to any paying tenant.

For those wondering "what your damages are", the answer is that the landlord can be sued for return of rent collected for any period in which they were in breach of their legal obligations to the tenants. In some states you can sue for return of the ENTIRE rent for a single violation by the landlord in a given month.

For instance, if they put your lives in jeopardy by shutting off the fire alarms or sprinklers without telling anyone, they can be fined by the fire marshal and required to return the rent collected while providing unsafe premises.

The landlord is the agency's client. The landlord pays them to find you and manage it. If he knocks on the door and wants in without 24 hour notice don't let him in. Contact your lawyer or housing authority about laws in your area. What is he doing on the property everyday? Is he doing something he needs a permit for?

A better idea is to lock the door and don't let him in.

Your contract is with the landlord. If you are going to sue anyone it would be your landlord. That being said, what are you going to sue for? You might want to take the time to reread your contract. Yes, the landlord is likely required to give you 24 hours notice before entering the property, but nothing prevents him from knocking on your door and you letting him in. The owner who is the landlord, I guess, is on the property EVERY day. He makes lots of noise on the weekends and even at night. He knocks on the door at random to access the attic where he stores his antiques. He also wants into the basement from time to time (on holidays too) He uses our trashcan. He moves my yard sculptures and plants around. He never puts them back. The list goes on and on....My husband and I have brought all these issues and MORE to the rental agency's attention. They say there is nothing they can do??? Who do I sue??? Thanks a lot!!!
