My mom is the executor of her mother's will. In the will she left the house to my mom. Does that mean my mom owns the home?

Like some of the others say, once the estate is "settled" and the debts paid off and other priority gifts made, the title of the house would be put into your mother's name by the estate (under authority of the executor, subject to approval of the probate court).

However, another issue to consider is whether the house is actually part of the estate. The owner of the house can grant the title to someone else up to and including the day the owner dies or becomes incompetent. That would make anything in the will that discusses the house completely meaningless.

That means that once the estate goes through probate and all debts are settled, if the house is still available as part of the estate, she inherits it.

A family member of mine had his evil spouse die. He inherited the house but left cash to her kids. After her debts were settled, there was no more cash so the house had to be sold to pay off the kids. The woman and her kids were true evil and left my retired 65+ year old relative homeless. Point being, inheriting a house doesn't guarantee you get the house if the estate has outstanding debts.

Edit: Another family member was a paralegal. She was executor of her mother's estate and both her brother and sister's. She inherited on all those wills. Being executor does not remove the right to inheritance.

The Executor of the Will isn't suppose to get anything they are suppose to be a neautral party. But if the person left the house to ur mum in their will the ONLY way that ur mum owns the home and it hasnt been tampered with is when the person is dead. But ur mum does NOT own the own while the person is still alive.

It means she may own the home, assuming the estate doesn't have to sell the home to pay debts.
