OK, so to answer the question - You were given a proper notice to vacate and you turned in the keys to the owner. YOU are the one who tried to defraud the property owner by "illegally" subletting from the tenant.
It is not the LL's problem that you moved out prior to the end of your 30 day notice period.
You agreed to commit fraud against the original landlord and got double crossed. Everything about what happened is not legal, including your part. You did the walk through and you gave up the keys. You are considered moved out, you are the one that decided to leave before the 30 days and that is how the courts will see it. I love how people rent this places that obviously are not legal rentals and then complain about the landlord doing illegal things. HELLO YOU ARE KNOWINGLY RENTING AN ILLEGAL DWELLING FROM SOMEONE WHO IS ILLEGALLY OFFERING IT FOR RENT. THE LANDLORD IS NOT FOLLOWING THE LAW TO BEGIN WITH THAT SHOULD BE YOUR RED FLAG TO NOT RENT FROM THEM!
Lol. You're not going to get very far in court when you're forced to reveal that you got duped because you thought and intended to collude with the other tenant to dupe the landlord and circumvent the notice to vacate you were served.
If you did a walk through through the empty unit and handed the landlord the keys, you moved out, period.
Unless you have a lease saying otherwise the owner has the right to make you move with a 30 day notice. The other stuff s irrelevant
The tenant tried to involve you in committing fraud against the landlord. You agreed to do so, even with fraud being a felony.
You can't complain in court that you were "tricked" as you, yourself, was in the process of committing a crime.
You willingly moved out, so it is a done deal. If you thought you would be able to commit fraud as well is not a real point.
Tell the owner and the tenant you are going to report the illegal guest house. You yourself made a few
bad decisions during this fiasco. Learn from it.
Sorry, your screwed.
I was renting a garage converted to guest house w/utilities incl. The owner lived in main house but some time later owner moves out and rents main house to a family. About two months after that owner calls me and says the new family tenants feel I should pay utilities as they are paying for all utilities. I say no problem and agree to a set amount and am to pay utility separate directly to family. I think issue resolved, well the very next day the owner calls back saying the family doesn't want to take my money and that this is turning into a big hassle so the family is just going to rent entire property. Owner gives me 30 day notice to vacate.
A week later the father from the family knocks on my door and asks if I found another place to move to yet. I say no. He then offers me to continue staying but now pay rent directly to him. I agree. Something I find strange is that he don't want the owner to know. He suggest I move all my furniture into a shed in their backyard and act like I am moving out and do the walk thru with owner and give him keys. He said come back next day and move all my stuff back in. I agree. Well once I'm out and keys are turned in to owner the family doesn't let me move back in. It was all a trick to get me out as owner don't want to take it to court as the garage conversion is not permitted and legal. I would've moved out anyways, but by them tricking me caused me to stop looking for another place to move to and now I am out with no where to go.
