If she is saying/writing things that aren't true, it is illegal. It becomes defamation and slander or libel.

The BBB won't handle issues like this. And even if she lies and makes a complaint, you can respond. The BBB is not a regulatory agency, so one complaint by a burned landlord won't change much, especially since you will respond professionally.

You need to get an attorney to draft a letter to her stating your responsibilities under the law, her responsibilities under the law (like reletting), and asking her to cease and desist threats against the company, contacting contractors of the company, and anything else she's doing that is a harassing you. She also needs to be reminded that making untrue statements is defamation and slander or libel and is grounds for civil litigation against her.

Once the letter is sent/served, the company follows through with their end of the agreement. If she is supposed to be attempting to relet, get her into court over it. If she starts harassing employees, call the police. If she moves forward with her defamation threats, get an attorney on it THAT DAY.

None of those threats or actions are illegal. Her threats are meaningless until she follows through on them. The law differs from state to state, but typically once you sign a lease the landlord can, but is not required to market the property, but instead must simply make it available to be rented by another. Listing it would fall under marketing as any Realtor will tell you. You, on the other hand can market the property. Sorry.

If you are paying rent and all other costs stated in the lease, she has no right to do any of that.

If you are not paying, then she has every right to do it.

That lease was legally binding.

So many faults in your story it's hard to believe.

What does the lease say? She may not be so crazy after all. If in doubt, check with a lawyer.

My company was considering a move and even signed a lease for a new space. However, we chose to stay where we have been for the past decade.

We've never occupied the new tenant suite and notified the landlord of our decision to remain in the existing. We then offered to pay rent until she could find a new tenant.

Since this, she has done the following:

-Refused to list the space as available

-Threatened to turn our company into the BBB

-Threatened to place a disparaging add the local paper about

us/my company

-Threatened to tell authorities that we are a fraudulent

business and actually running an illegal operation behind the

scenes.

-She has shown up at our accounting firms office, walking in

and demanding that they cut her a rent check on the 2nd of

the month.

-She Demanded that our accounting firm give her an unsigned

check, to which she intended to hand carry to my home for

signature.

-Grilled the accounting firm, demanding to know if I pay my bills

-Told my Senior Manager that I will not like where she is going

to take this...

Etc. What are my rights with this crazy lady???
