If the answer is yes, then read it. That will spell out the requirements for both side (you and the landlord), and if there are any weird things written in the lease, that will trump any "typical" rules of renting..... here is what I find strange about what you wrote:
- Normal leases would have the landlord responsible for painting.
- If the landlord wants you out, he could very easily at the end of the lease (or any time if there is no lease) send you a new lease with the rent doubled, and say this will be in effect in 30 days... thus you either pay double or leave.
- If he is going to evict you, the court will have to be involved, so plan on going to court, document you mom painting the house and buying the supplies and all the other cr@p the guy is doing (documenting is pictures, correspondence etc, NOT you rattling off the stuff he did to the court)
At the end of the day, if you have no lease, no there is nothing that you can do. If you do have a lease, the landlord can change it when the lease expires.
But this landlord sounds like a douche. Why do you want to live there an give him you money?
I am also a tenant who has lived in my apartment for 12 years. It sounds like exactly what you said - your landlord is trying to scare you into leaving. What you can do depends on the landlord/tenant laws where you live. Research online the rental laws in your area. Do you live in a rent controlled area? Is there a Department of Housing in your town or city? Call them and ask what your rights are. Also research and ask about landlord harassment laws and what you can do about harassment.
he owns the property and can get you out of there for any reason at any time provided he gives you the proper notice required by the state.
Depending how many units he owns he might not even be required to follow fair housing laws, which eliminates a discrimination suit, so i'm not aware of anything you can do other than move out
It may not seem fair but how long you have lived there is completely immaterial and will not change anything. The only thing that matters here is if you have a lease.
With a lease. He cannot evict you unless you violate terms actually written into the lease. It is illegal to make up crap you are not legally required to do just to try to get you out. The painting stuff is complete crap and it would be illegal to evict you for that.
with no lease. He can give you 30 (60 days in some states) notice at any time & does not have to give you a reason at all.
Oil and Gas could set up a drill right next to the house with you living there if the owner allows it. They can even set it up without owner's consent if they own the mineral rights as most do.
So I doubt that's the reason for his wanting you to leave.
Is the house an eyesore? Best to just move.
If there is a lease, he can just kick you out after the lease is up. If you have no lease, he can kick you out with 30-60 days notice depending on location.
There is nothing you can do.
If you have been living in this rental for 12 years, your lease has expired, Normally this is the case. If no new lease has been signed, you are currently on a month to month tenancy.
With you being on a month to month tenancy, the landlord as well as you are required to give the other a 30 day notice of any intention to move to each other.
Neither of you would need to provide any reason what so ever for the decision to move.
You must know by now the landlord is attempting to get you out of the rental, it might be to your best interest to find another place to rent, and not go through a legal eviction.
You would get peace of mind and less stress, trying to figure out what the landlord would do next.
I hope this has been of some benefit to you, good luck.
"FIGHT ON"
In most places and under most leases the landlord has to honor the lease- can not evict you when you are under a lease. He can evict you with proper notice once the lease is over- no matter how long you have lived in the house.
We have lived in the same house for 12 years. Recently our landlord has been nit picking on every little minor mistake we make, trying to evict my family from our house. We are in a prime spot for the gas drilling guys. We think he wants to get rid of us fast so he can put a gas driller in there and charge them an outrageous amount of money for rent. A week or so ago he commanded that my (single working mother) paint the entire house. (He didn't buy any of the paint or supplies) She did just that with the exception of all the trim and touch up. He just sent a letter saying that he's going to evict us because the painting was not done up to his expectations. Is there anything I can do?!?
