Good lord. A landlord will not accept you living there.

There are guidelines a landlord has to process. Such as making sure you do not have a child molestation record, etc.

If I were a landlord and a tennant got a new person to live there without my permission and me checking them out I would be furious.

All heck would break lose.

Unless the person that is currently on the lease is authorized to sub-let, you would be considered an illegal occupant.

If this person that is currently on the lease is unable to pay the lease,this person should introduce you to the landlord. The landlord would require you to complete a rental application. Once you have completed this application the landlord would normally run a credit and background check to see if you meet the minimum requirement of a tenant he/she would accept.

Normally you would be required to prove the ability to pay the monthly rent as well as the deposit required.

If you meet the requirements you would be required to sign a lease or rental agreement.

Prior to moving into the rental unit the landlord would make sure all damage to the rental is repaired and it is clean.

I hope you did not give this person any money for the possibility of taking over her lease.This could be a scam. If you sub-let from her, you would be required to pay her the monthly rent, after which she would pay the rent to the landlord. She might be charging you more than she is currently paying for rent.

Basically you would need to contact the landlord to see if you are legally able to sub-let the rental unit.

Here's what it means:

It's up to the landlord to decide whether to rent to you. Not the previous tenant.

The landlord also can decide whether you're a full replacement tenant, or whether you're sub-leasing from the previous woman. It's not up to the previous tenant to decide.

Right now, without the landlord's approval, you're not allowed to be there at all. You're a trespasser. You have no legal right to be there. (And I'm starting to think that you've been scammed by that former "tenant.")

Contact the landlord. Explain the situation. Your best situation would be a new lease in your name. That way, your arrangement would be directly with the landlord. It would also mean that the previous tenant would be responsible (through her security deposit) for damage done to the apartment. But you'll need the landlord to inspect the apartment to determine what damage had been done.

If you sub-lease, then you're leasing from the previous tenant. In that case, the previous tenant would be responsible for the damage. But--and here's part of the problem--your rent would go to her; she'd still be responsible for paying the landlord.

Contact the landlord. Explain the situation. And pray that you weren't scammed by the previous "tenant."

On craiglist. Needed to get away from the Area I was at. Plus I needed to be closer by my jobs. Working in hotel and this clothing store and sale sea shells so on. Well I figure why not. My concern was the lady said she couldn't pay it no more and asked if I could finish the lease of which is like 8months so I told her ok. Closer by the beach area. Now that I've made an agreement does it officially mean its mines and my responsibility even whatever problems she had is mines it should I take it to the landlord about the carpet or messed up broken furniture??? So they wont charge me for the damages she did?
