Almost certainly not. Paying "late" is not the same as "refusing to pay". Every single eviction case I have seen for "non-payment" was dismissed the moment the court learned the rent had, in fact, been paid. The court won't generally order a tenant out for non-payment when payment is still being paid. Until the landlord makes it about something MORE than the money, you probably cannot be evicted.

Some states even have statutes that prohibit late fees, let alone eviction notice, until three to five days after the due date.

Check the copy of your lease and read the terms for eviction. Your LL can not just make up a reason to evict you - it must be written and agreed upon in the terms. Don't guess,KNOW! And don't make it a habit or pattern of paying your rent or any bills late. This does not look good and will ruin your credit and/or good financial standing.

Check with your landlord advisory association in your area to clarify the rules in your area. They may differ from state to state. Usually the landlord has to give you notice to evict (14 days). If you pay your rent in that time period the eviction notice is void. If not they can petition to the courts to have you removed.

Yes, of course they do. The LL has bills to pay that they use your rent money for. Would it be OK for your employer to pay you late every payday? Of course not, and it's not OK for you to be habitually late with rent - rent is due on a certain day according to your lease. Every time you pay it late, you violate the lease.

Being rude is not illegal. You might be rude to your boss if he was always stiffing you for money.

Most definitely. Your LL is tired of you paying your rent late and has given you fair warning what will happen if you are late again.

How is it racist that your LL expects you to abide by the terms of your lease? BTW, it is not against the law in this country to be rude to someone.

If you are even one day late they can give you a 3 day pay or quit notice then file eviction papers. A bank does not care about the date on a check and they are willing to deposit it so that would be a bad check which is a felony.

A landlord has the right to evict you if you do not live up to all of the terms of the lease. Race has nothing to do with it.

They can kick you out for late payments, pay your rent and you won't have problems. And yes, a post dated check is late.

Does a landlord have a right evict if you make late payment on rent? I have a lease. She stated to me any future late payments will no longer be accepted.
