If you paid the rent by draft or check you could have followed up with the bank it was drawn on and found out if it was cashed or still outstanding. If it was outstanding you could have stopped payment and the bank could have reissued another. Instead of doing this, you challenged the landlord and created a negative situation. The landlord is only an employee of the tenant board and has to follow their lead. Since you are currently caught up on all payments, they will probably stop the eviction but do not have to as they are in accordance with the contract (lease). Good Luck

Well, I don't think it is up to you if you pay the fee or not. Go to the hearing. Bring your copy of the agreement, along with your proof that you followed the agreement to the letter, as well as your proof that the arrears is now paid in full. I doubt he will be able to evict you, as there isn't any arrears at this point, however the fee still needs to be decided. I don't know his argument, but one that will work is in his favor is that you did not adhere to the agreement (were late, or maybe short on the payment) and you only paid because of the upcoming hearing. If he makes this point you can expect to pay the fee. He shouldn't pay it only to collect his income from your pockets. However, if you were doing exactly what you agreed to do he should pay for the hearing as he is using it to alter the arrangement.

So here's our situation, my husband and I were one month behind in rent because our property manager lost our draft. I have no proof of this but we kept paying rent consistently after that. We had an agreement with our landlord for a payment plan to pay it back and I do have written proof of that. He there after had sent us papers from the board, applications to evict us and then he called us saying our arrangement is no longer valid. He made a hearing date to evict us and our 1 year old baby so we just sucked it up and paid everything we owe. Our hearing is in 10 days and were extremely upset. Were current in rent now but we are angry that he went back on his payment plan that he agreed on. He has interfered with our reasonable enjoyment of our rental unit and he expects us to pay the application fee which we are NOT going to do. What are our rights? Do we qualify for any sort of remedies? Please someone help. thanks
