You didn't realize until after the weekend that money was taken, which would be a serious problem if you had to go to court. It doesn't really matter anyway, it definitely wouldn't be the landlord's responsibility, but rather the contractors they hired.
You wont win anything, next time, put your money in the bank. It will be impossible to prove that the money was even there to begin with, let alone taken by someone other than one of the three roommates or a visitor.
You legally waive any notice to enter when you make a repair request. Once you make a repair request the landlord can have someone come fix it as soon as they can. You do not have to confirm, ever agree to it at all or be there. The landlord has every right to give any contractor a key that they see fit. The landlord did not break any laws or do anything wrong.
Your case, if you had one, would be with the contractor. As others stated your problem is proving the money was ever there & that someone else did not steal it over the weekend. Did you have a party or anyone over? if so you lose your case on the delay in reporting.
All a landlord has to do is to give you a 24 hour notice that he will enter your rental. No reply is required; once notice is given, you cannot deny entry.
The landlord did indeed give you the 24 hour notice.
As for taking the landlord to court, go ahead. Anyone can sue anybody for anything. Can you win? That is the real question.
When you sue someone, the burden of proof is yours. You need to prove that the landlord was indeed responsible for the alleged theft. Without proof you cannot.
You could also report the thieving A/C workers to the police. But, again without concrete proof, there is little that the police can do.
Take care
A certain amount of notice does not even have to be given to repair something YOU requested a repair on. If the landlord wants to enter for a reason they have then they need 24hrs notice. They have the right to leave the key for the repair people and you do not need to be home. You have the right to use a bank for your money or lock it in a lock box and hide it away... that's what I do with any cash I want to leave at home. You can sue the workers or you can sue the company they work for and you can sue your landlord, but when you sue you have the burden of proof... so collect all the evidence you have to prove the money was there and that they stole it... otherwise don't bother. If you simply don't have your rent money to pay your rent and thought this was a great way to cover that fact up... don't bother, its not going to work.
A lot of cash laying around. Open a savings account
For an emergency repair zero notice is required
What does your lease say? Can the landlord provide a key if you are not home?
The 650....come on....add a few more zeros!
It was Roomate #3 who stole the money, in the library with the candlestick.
A long story short...
Our ac went out in a house we rent. My landlord called an ac company and texted us on Thursday that they would be out "Friday morning" (the following day) no one responded to this text to confirm..The ac guys came Friday morning entered our house while no one was home with a key that she left for them WITHOUT TELLING US. On Monday we realized we (3 guys that live there) where all missing a total of $650..we all feel she is responsible for out money missing and should pay us out money or we will be taking this to court. Am I missing anything here or am I in the right to do this? Thanks.
