In WI, you are required to give 30 days notice, that runs the same period as your lease.
If your lease is from the 13th-12th, then you give notice now and that will cover 10/13-11/12 when you have to be out.
You also CANNOT withhold rink. You live there you pay. You don't like it, you move. If you move out against the terms of your month to month lease, you deal with the consequences.
A lot of the issues are cleanliness. If you have been living there for almost a week, I hope you have cleaned the floors, sink, toilet (you can't who made the urine by you looking at it. Seriously, that makes you crazy sounding).
I don't see why a landlord is going to fix "a tile". It's super expensive to fix "a tile" (it's doubtful that the one can be popped out and another laid in it's place). It's not an issue of habitability, so would not be illegal to not correct this problem.
I don't even understand the tube in the shower issue.
You didn't choose this place because it was the best offer in the area. You choose this place because of some other reason. You didn't select a pristine and you shouldn't be expecting it.
I suggest reading the Wisconsin Landlord Tenant Handbook and your lease. In most states, you are allowed to deduct maintenance items from rent if you've notified the landlord of things that need to be fixed and they don't get fixed in a timely manner. Cleaning service, aesthetic items do not count.
If you don't want to live there because of the poor response from the landlord and the aesthetic issues, then you should put in your 60 day (or whatever you lease allows) now.
Next time, don't move in if the landlord hasn't done what they were supposed to do OR strike an agreement that rent will be discounted until it is.
read your lease agreement. There should be very specific details in regards to maintenance as well as what needs to be done when you move out. Most likely you are required to give 60-90 days notice or forfeit your deposit. You can always pay to have the maintenance done and then bill your landlord. if he doesn't pay you take him to court. However none of the maintenance seems very expensive. Don't you have a guy friend or 2 who are handy who will take care of it for a case of beer?
I think you can fix most of these things. Ask landlord for reimbursement or rent abatement. You must give 30 days and pay for 30 days notice. Yes you pay for Oct rent since you give notice Oct 1 and leave Oct 31.
A list is not a signed agreement to have the repairs done. You have been scammed by a slum lord.
In mid August the landlord and I did a walk-through of the house and discussed everything that needs to be fixed. We made a list of that. It is now almost October and he's only done a couple of things. I had officially moved in last friday and the place was disgusting. The floors were dirty. Spiders everywhere and a roach. Dirty sink in the bathroom and urine on the toilet(looks like a man did it). A tile in the bathroom still hasnt been replaced. Kitchen sink had really old food in it. The shower does not run hot water and there is literally a huge tube w/ a hole in it that leads to outside so anything can get in(i didnt see it before b/c of how high it is and where its located). The bottom lock at the front door does not work either(he told me it would be fixed and hasnt touched it).
I sent him a text explaining the shower and the hole b/c i feel thats most important. I also asked him when the other stuff would be fixed. I never got a response(we have sent texts back and forth previously about maintenance). I will be calling today as well.
Also i have a month to month lease. I gave him 2000 for a deposit. First, last months rent, and security deposit. If i give him notice and move by the first do i still pay for Oct rent or does he use the last months rent i gave him?
Who would i talk to or report him to? This is in Wisconsin. Helpful answers are apreciated.
