Landlord kicked us out now threatening with court?

Sounds fishy. Even without a lease, she still has to give you 30 days written notice before ending your tenancy unless she evicts for non-payment. Either way, she must provide you written notice, not verbal. Tell her to go ahead and file in court. Then you can tell the judge she didn't provide proper notice. You can not be arrested for civil matters like this. The worst that can happen is she puts in a bad report on your credit. However, expecting her to wait an extra 2 weeks for the rent with no deposit or anything was taking advantage of her.

She's blowing smoke - she can't have you arrested for owing rent. She could take you to small claims court for the two weeks rent, that doesn't mean she'd win. And sounds like she's doing a whole lot illegally. If she does sue you, tell her you'll be reporting her to welfare and to the IRS. See if that municipality requires an occupany permit for rental property - many do - if so, report her there too.

She is making an idle threat about having you arrested. You are not arrested for violating or being sued in a civil court.

Make sure you have the dates and any written evidence to take to small claims court with you to protect yourself in the court room. You would want to make a couple of copies of your evidence, the judge might want copies of your evidence.

You might would want to see if you are able to make some type of deal with her about what she perceive as you owing her. She might take half of what she think you owe her.

You know how she is, therefore you would want to have her sign a receipt saying final payment or debt paid in full for rent and deposit at 123 Lame Duck Ave.

As most have mentioned, you might send to the local welfare office a letter indicating you were renting a room from her and she has a current tenant residing there now.

If you think this is too vindictive and would want to move on with your life I can understand that. It might not be worth it and would be time consuming.

Normally when renting make sure you are provided some type of lease or rental agreement as to the terms and what would be included in this agreement.

You would also want to have your finances in hand so you are able to pay the rent as well as the deposit.

I hope this has been of some benefit to you, good luck.

"FIGHT ON"

< She just called me again tonight saying she's gonna take me to court and have me arrested because I haven't payed the week and a half rent money for when I lived there. >

Call her bluff by saying you are going to contact the Department of Social Services that she is renting out rooms.

Call her bluff, say if she goes through with her threats then you'll report her for renting out her accommodation and not declaring that to the social people or the tax people. I don't know where you live but if she's claiming any sort of benefits from them then she is acting illegally and they will prosecute her.

Don't bother contacting her back. Just call the welfare office and SS office turn her in for fraud. Keep those two pieces of mail as evidence that you lived there. Tell them she has another tenant in the house now. Let the welfare and SS cheat get what she deserves!

You took possession of the property and the landlord has the right to rent for at least a full month. She can't have you arrested, but she can sue you for not paying.

there is this line in a movie...Michael clayton....near the beginning.....guy hit a guy and they were talking ...the phone rings...guy asks is that the cops.....George colony goes...''cops don't call'' think about it...play this throught...where is the crime...I will give you a hint...you never should have moved....the crime is.................your honer, is there anyway I can get some sort of reward...this lady just admitted to fraud....you know right...got to think these fake questions through.....

Hello

So tell her you will report her to SS for illegal renting which will get her house checked to see if it is legal for her to rent a room and get her medical contributions immediately suspended whilst they investigate the report

Andy C

She wont do a thing since she will lose her medical aid and socsec reduced. Don't threaten, just hint.

But you have to see why you have not met your own commitment.

OK

StatePA:here about a week or 2 ago I rented off a lady. She told me I could move in without security deposit and pay first months rent when I got my pay check from work. Well I was suppose to get my check on the 12th but it got pushed back til the day before thanksgiving. Any ways one night she called me upstairs with 2 pieces of mail in her hand and asked me why I was receiving mail there. She had told us we could not report that we were living there because she said that welfare would cut her off her medical and she would get her social security check cut down. So she jumped on my case about the mail and then proceeded to ask about the rent. I told her I would have the rent the day before Thanksgiving. She said that was fine. She charged me $550 a month all utilities included. Anyways 3 days later she calls my work and I get pulled off the floor. She wanted to tell me that she was kicking us out because she didn't feel we were gonna pay rent and she had someone offer her money 4 months in advance to live there. We moved out the next morning with no where to go and no money. Thankfully my Uncle opened up his home for a few days to us. She just called me again tonight saying she's gonna take me to court and have me arrested because I haven't payed the week and a half rent money for when I lived there. She proceeded to say that she has bills etc stating that I ran them up, when she said all utilities were included and she would show those to the judge. There was no lease sign.
