If you don't have a current lease then you have no options. Assuming 30 days is valid where you live then he did everything right. He does not have to allow you to stay there beyond the 30 days. If you do, however, you will owe for that time and possibly the entire month depending on your state laws.

Find a place where ever you can. Drive your son to school and don't update your address with the school. Keep looking over the coming months.

A few things:

* Your payments were not on time if you paid them 2 to 3 days past the due date. They were 2 to 3 days late.

* Landlords like tenants who are happy in their place who aren't causing trouble. If you pestered the landlord about improvements then he likely got tired of you. If you were serious about new carpet then you could offer to help pay for it up front or through an increase in rent.

* You may not get many answers to this. The grammar, wrong words, and lack of periods made it extremely difficult to read.

The landlord is not required to replace the carpets. The landlord does not want to replace the carpets. The landlord would rather rent to someone else than replace the carpets.

The landlord gave you a 30 day notice to move. The landlord is going to evict you and take you to court if you don't move. This will go on your credit report and it will be hard to rent again in the future. The landlord will also send you to collections if you owe money.

He can't send you to collections if you don't owe him any money.

Since this is a deposit dispute you just need to prove you left the place in move in condition, no repairs or cleaning was required before new people could move in and that you gave a 30 day notice to vacate. For him to win he has to show cleaning was required, or there were damages, or there wasn't a 3o day notice, or you had unpaid rent.

Being consistently late shows you feel entitled to other peoples money, even just for a few days, but will not effect you ability to recover your deposit.

With no lease he has every right to give you notice to vacate at any time & does not have to give you a reason. NO landlord is ever required to change carpets for an existing tenant. Unless you have unpaid rent there is nothing to send you to collections for. If you are not out at the 31st day he can file an eviction though.

Did you actually sign this new lease? If you did he can't give you notice to move. If you did not then you are a month to month renter and he can give you 30 days written notice of one full rental period to be out and you must be out.. simple as that.

Hello there, I'm in a bit of a pickle at this moment. I hope I can find some more information regarding my current situation. Well to make this long story short I signed a lease for 1 year for a 4 bedroom home while I save and built my credit to buy a home for my family I always made my payments on time within 2/3 days after due date. The first year ended in 2013 and I never received a lease renewal form from my landord for 2014 but I still kept paying him each month I eventually did ask for the new lease form and he agreed that he will bring it to my home so I can sign it so I didn't mind it sound it grate what a grate person everything was fine till

I started asking my landlord to change the carpets on the home which was something we've been asking him todo since last year because they give off this odd smell well now his asking for the home he gave me a notice for 30 days to move out it's been 20 days now and Im having trouble finding a home near my kids elementary to top it off now my landlord is making threads if i don't move after the 30 day notice his going to send me to collection, I even try to reason with him I offered to pay the month but he ignored it. What can i do if i don't happen to find a home before the 30 days notice is due, also im already moving everything into a storage just in case worst come to worst everything from home will all be secured at my local storage.
