As an owner of a trained guard dog myself I will tell you that you need to seriously rethink this animal. A decently trained guard dog is not unpredictable, in fact the opposite is true, it should be 100% predictable and 100% under control. One command that this this person is "OK" should be all the dog needs to know that under no circumstances are they to ever even think about harming them. If the dog can't be trusted you really should not have it on your premises, renters or no renters.
You got to be joking?? Even if you could draw up such a contract, it would never be enforceable in a court of law. As a dog owner, you are 100% liable for damages caused by your animal.
Animals react in instinct. It doesn't really matter how well trained the dog is, there are times when instinct overrides any human training or commands. Therefore, it is your responsible to restrain your dog. That is exactly why you going to be held responsible if something should happen.
Maybe you can get out of the lease legally but I dont know how. You shouldnt rent to them but then they may sue for discrimination in this crazy age of stupid laws. You should check with a legal source to see how to protect yourself from a lawsuit. Look up the state landlord-tenant regulations.
Unless your dog is contained, you will be responsible and since you have a dog that is on the ... bad dog list...you can be sued big time. Telling someone and having something in writing is a big difference. YOu need to protect yourself and keep their kids away from your dog. German Shepherds are great smart dogs so protect your dog. From what I have seen it is easier to train your shepherd to stay away from kids rather than have tenants learn to keep their kids away from your dog. You will find that while tenants may say anything, they will respond badly when their kid gets bit. At least get it in writing and have areas they can use and areas only your dog can use and fence it off.
You can have the tenants sign anything you want, but it doesn't matter. If your dog hurts anyone, you are liable.
Your best bet is to get a really good liability policy.
You better have good insurance, you can't set up a contract that will hold up if the dog injuries the child.
You will be responsible for injuries no matter what they sign if your dog attacks them or their child. You should not rent to them, horrible idea, major liability.

We are located in California. We are the landowners of the situation below.
We have a studio located on our property. Along with this, we have a trained guard dog(German Shepherd). Our soon to be tenants have children and we have told them that the guard dog, though trained, may be unpredictable. Regardless of this, they have decided to move in. My dog IS vaccinated and registered in this county.
Does anyone have a generic typed up contract or something that I may use that will let the new tenants know that we will not be responsible for any injuries(scratches, bites etc) cause by any animals on the premises.
