If he only put that in his description, then yes you can file a NAD (not as described) case and he will be forced to answer. If he doesn't allow you to return it, he will be forced into a refund automatically by paypal/ebay. because he only put a picture of the other box, that is taken as the item in the description. It does not matter what a seller puts as their return policy, ebay's item description policy overrides that every time.

You bought a "like new football visor". You received a "like new football visor". The photo apparently showed the box, not the visor, and you stupidly ASSumed it would look like something you envisioned.

It was your own dumb fault for not asking questions and not asking for more pics BEFORE the sale, not after. You are stuck with it.

From eBay's Resolution Center:

"I received an item that does not match the seller's description."

You file the dispute. This will force the seller to take notice or refund your money one way or the other.

look at the listing and see what his return policy most people have a 14 day return day policy
