Did you pay cash or have credit card records of getting the money order at that approximate date, though not as strong as an actual receipt, showing you put the money in to get a money order combined with their flakes records might be convincing.
You can lookup tenant right s guides, but I saw nothing touching on your situation.
This is the sort of thing that could end up in small claims court, you may have to initiate the action if the go straight to eviction.
Evidence of their incompetence can go in your favor with the judge.
You should have proof of your generally consistent payment record if possible.
Go back to where you purchased the money order from; they should be able to track down the purchase record of it.
Have some good tracking info to start with, like a date range and dollar amount.
They should be able to find the purchase record within a few days. They can then verify if it has cleared or not. If it has cleared, they can print out a copy that you can take to your landlord to show it's cleared. They can then cross reference that image through their bank account to confirm.
If it has not cleared, the place where you purchased it from should have a procedure for you to stop pay that original money order and have it replaced with a new one.
Hope that helps; good luck.
You call the place that you got the money order. Tell them the number and they will tell you the status of the payment. If it was paid, they will provide you proof. If it wasn't, they will cancel it and you can get a new one for the money that was never paid.
Clearly you should keep your receipts, without them you have no proof, so you can be asked to pay again
i honestly could never understand why people use money orders vs a real bank account/checking account.
Our apartment complex just had a change in property managers. The new one is saying that the old one lost our money order for rent for March of this year. It shows in the ledger that we paid, and we even paid the late fee. It shows the money order and receipt for the late fee, but not for rent. No receipt, no copy, no money order # and no proof it was deposited towards our rent. I unfortunately don't have the recipts either(I know, big mistake) I'm wondering what our rights are. Their ledger says we paid, it just doesn't show proof of any money order. What can we do because they're going to try and make us pay again. Their old manager was very incompetent.
