Parents home foreclosed and we had not fully vacated.?

The lender does not have to wait for the prior owners to vacate before foreclosing - it is the responsibility of the owners to make sure everything has been removed. However, state laws may require the new owner to safeguard the contents of the house (in which case, they may be moved to a storage facility and yoru parents can get them back by paying the facility fees).

That's what happens when they ignore the notices from the bank about being behind in payments, and that the bank is starting foreclosing procedures. There were notices, and ignoring them is not a valid defense to have more time.

If you want to get your items out of a foreclosed home, you will need to contact the lender and make arrangements. They can not hold your personal items hostage. Good Luck

if you were notified of the date you had to be out of the house, that is the date you no longer have access to the property

if you were not able to get everything out of the house by that date, those things are lost

you might ask the agency that foreclosed if you can retrieve your stuff but they are not obligated to do so when they served you a proper notice

If you live in a state that requires judicial foreclosures then your parents were notified of the foreclosure from day one. If you will check the court records (available on line in many areas) you will see the notices sent to your parents.

Many states require notification an a certain period of time to move. The contents in the home after this period will be put in storage at your mothers expense.10 days after the sale is required in Florida. Other states may have different laws. None of us experts here can clearly answer your question.
