It does not really matter what the brother says. The house is legally your mothers, she can do whatever she wants. Her plan seems to be fair and in everyone best interest, as long as there aren't other children. Since the father bought it then it should be split by all of their children.

If the house is in your mother's name, she can sell it/gift it/give it to anyone she pleases.

my father bought a flat on my mother's name 10years ago. recently he died.

my brother who troubled my parents a lot with his drinking habit spent my fathers hard earned money,my father wrote in his dairies that i elder son gave money for thier living where as younger son spent thier money with siignature.

now my younger brother is telling that father told him that the flat belongs to my brother,my mother wishes to sell the flat and distribute the money to her 4 children 2boys & 2girls which i accept.
