You are not under rent control.

The landlord can raise the rent in accordance with your lease

- If you are on a fixed term lease, they can't raise the rent until the lease is over

- If you are on a month to month lease, they can raise with 30 days notice.

- when they raise the rent, they can raise it as much as they want (unless your lease says otherwise).

They can use the SF rent control guidelines if they want. Whether they use this as the guideline or not, it has no impact on you.

SF laws do not apply to you, only sate law. State law is that you receive a 30 day notice. You can submit your own notice, a notice that you are vacating, if you disagree with the new rent.

Doesn't matter. If they choose to raise the rent they can with 30 days notice.

Rent control applies to the house, not where your landlord lives.

Our real estate agency that we rent from is located in San Francisco and our home is located in a neighboring city of Daly City, CA. We recently received a noticed that they are raising the rent of our home. At first we were bummed, but we understood that San Mateo county (where Daly City resides) does not have rent control, but the notice they sent us they claim to use a San Francisco code to raise the rent on us.

So are we subject to San Francisco Rent control laws because they reside within San Francisco or is this a mistake?

Were are currently paying $1900 a month and they want to raise it to $2100, but if they are abiding by SF laws they can only increase by about 1% for this year which does not equal $2100.

This unfortunately is not the first time they have raised rent on us like this, but this is the first time we have noticed the claims they were using. We started at $1700 and they raised $100, then $100 again a few years later to $1900, now this. Any help or advice would be greatly appreciated.

We have already begun the process to seek outside help on this matter from professionals ,but I would like as much help/advice/guidance/experience as possible. Thanks again!
