Your choices are:
1) The apartment is not habitable and you move out; or
2) You stay and pay rent either to the landlord or into an escrow account.
In most locations it is illegal to withhold rent for a unit that's habitable that you are occupying. The few places that do allow that require you to put the rent into an escrow account. After the landlord attempts to make repairs he gets the rent. You living there and NOT paying rent is not an option.
Please note: landlords only have to TRY to fix something. They do not have to actually fix it as long as the unit is habitable.

I'm renting an apartment with my boyfriend whose cousin is the landlord. The room has damages on the floor, ceiling, and Windows. We asked him to fix them since we moved in which was four months ago, but it never happened. This month we told him according to pa rent withholding act we will withhold the rent until you fix at least the floor. Then he tried to do it but it was impossible because you'll have to drill through the foundation for that. Now the room is the same and he's saying we should pay rent because he tried to fix it . We can't move out yet because we're still looking for a place and I don't want to pay a large rent for a shitty room. Can we pay a little less in this situation?
