Scratches caused by Landlord?

The landlord may have gotten a discount due to the scratch. It's good you took a picture. Send a copy and note to the landlord letting them know of it just in case the damage was caused by the delivery instead of prior to purchase. That may help cover you from getting charged for it. However, you should have notified them as soon as you noticed it rather than waiting. Now unless your picture has time/date on it, there is nothing to show when the scratch happened.

NO they cannot charge you for damage caused by the installer. You should have told them at the time. Your best bet is to mention to them NOW. Just say you figured they saw it but wanted to tell them just in case. The installer is the one responsible.

IF do try to charge you then all you can do is dispute the charges in court.

EDIT: Ok its good you did tell them and yes a bit late. From this point all you can do is remind them at move out it was the installer that caused the scratch & sue them if they try to charge you.

Just to be clear we are talking about a scratch in the floor not the machine - is that right?

He can try and probably will but you have the evidence it's the world we live in sad isn't it

Well if your landlord said it was OK then you won't get charged for the scratch. Stop worrying so much otherwise your hair will start to fall out.

YOUR problem could be proving when the photo was taken (cos even the time/date stamp dont prove it - all you had to do was say yesterday set the camera to the date it was installed then take the photo

Lo and behold the photo would then have that date on it even though it was only taken yesterday)

And as he said you SHOULD have notified him of the scratch the day it was installed (by letter- with the date on it and you keep a copy, or better via email). Then you would have a record that it was there when installed

A few months ago the washing machine broke down and was changed by the landlord. The landlord (via the retailer) took care of all the changes but when I came back I noticed a very big scratch by the machine.

At the time, I didn't notify the landlord as I received a call from him saying everything was ok so I guessed he must have noticed it.

I did take a photo of the scratch on the day the machine was changed as a proof for check out.

Who is liable for this scratch? Can the landlord take money out of my deposit for this particular scratch?
