What does not repaired mean? That no one has come and looked at the problem or that someone has been out to assess the situation but no repair has been made.

If no one has been out and it's a necessary repair, you call our section 8 case manager or the health department. If it's a non-required repair and someone has looked at the problem but the repair is has not been made, you deal with it.

Your rights are the same as every other tenant when it comes to repairs. All repair request should be in writing. No landlord is ever legally reacquired to fix anything but health & safety issues. AC is not legally required to be fixed at all in any state except certain parts of AZ.

While I feel sorry for the kid as i have asthma too but they would not be breaking any laws if they don't fix the AC.

and no you are correct that you cannot go to the owner. Owners hire managers to avoid dealing with tenants. Even if you did try to contact them they would likely ignore you & tell the manager to handle it.

Check with your local housing authority. Depending on the nature of the requested repair, they may intercede if the complex wants to keep their Section 8 status.

What is the repair? A week or so may not be unreasonable.

California law does not require AC to be installed. If the landlord does not repair it in 30 days, I suggest you buy a used AC yourself, or pay for repairs and request reimbursement from landlord or rent reduction but you cannot withhold any rent to get it repaired. You will be evicted. I know it's warm right now.

Section 8 or not makes no difference in this issue. Being rude is not against the law. You have to make other adjustments for asthmatic children, like buying some special equipment. If you do, you may get some taken off your rent portion for that. You are free to call your case worker and ask for help.

There are no special 'tenant rights' because you are a Sec 8 tenant, other than the same rights extended to other types of tenants. You failed to state what types of repairs were requested. If the requested repairs do not affect 'habitability', they can take forever to address it.

hi, i am a section 8 tenant in van nuys, ca and the property was recently sold to an investment llc. since the sale, the repairs of this place and become lack-luster. i gave a request for repair form to the 'manager' on last monday and a week and a day later, no repairs have been made. do i have any rights? we cant speak to the real owners...we have to goto these 'front men' who are rude and take their time. im sure the owners are not aware of the problem.

what should i do?
