Different states have different "agency" laws. Some, like mine do allow your scenario but understand while each agent may be under the same principal broker the individually have a (legal) fiduciary responsibility to their different clients. You situation isn't exactly dual agency since different agents are representing different clients.

As for the foreclosure, the agent was telling the truth if the property is a HUD foreclosure. And if so your agent isn't the sharpest crayon in the box since HUD homes offer a higher coop commission.

In this case the Broker represents the seller, and the subagent is supposed to be representing me as the buyer. If I'm not mistaken I believe the Buyers agreement was solely a buyers only agreement and not a dual agency agreement. Can the sub agent still represent me if she works for the broker representing the seller? I do appreciate your answer..

If you're saying that the broker him/herself is the owner of the house: Yes, the Realtor can represent you. The Realtor must disclose dual agency, and you must agree to it. But if those conditions are met, the agent can represent you.

Regarding giving you the access code: Legal but prohibited by licensing regulations. An agent is not permitted to allow unsupervised access by a non-licensed person.

The broker/agent can legally represent both sides of a property transaction but need to have you sign an acknowledgement of disclosure form.

I recently entered a buyers agreement with a realtor whom works for the broker that is selling a house I am interested in. Can the realtor represent me if they work for the broker selling the house? Another question I have is: I asked the same realtor to show me a home that was forclosed on in Texas, and she gave me the access code to the home and informed me that I didn't need an agent present to view the home. I felt uncomfortable with this and thus never went to view the home, but I want to know if that is even legal for her to give me that access to the foreclosed property.
