Tell them that by refusing to exchange they are in breach of their own terms and conditions

(either quote there terms and conditions or give them the reference for the paragraph)

and that by breaching them they are in breach of the sale of goods act and that unless you get an exchange you will sue.

(From what I have read I believe they are also in breach of the distance selling regulations

The paragraph you quote as regard returns/exchanges is rubbish

Under the distance selling regs you are entitled to a full REFUND for any reason if you notify them within 7 days that you want to return the goods (just sending e-mail is ok). Its irrelevent who the manufacturer is)

You say - "they apologized and there contacting the designer for consent"

Just tell them that as far as you are concerned its IRRELEVENT what the designer say cos your contract is with THEM, NOT the designer. and if the designer does not consent then its THEIR problem, NOT yours

(they are trying the same old trick that retailers used to use- "its the manufacturers responsibility, not ours.

No company exchanges either underwear or swimwear for obvious hygiene reasons as the items are worn next to the body.

I think you'd have a hard time convincing anyone that your measuring is more accurate than that of a an actual clothes retailer

You might gain a little leverage by spending some time searching out the vrious scam and ripoff reporting sites on the internet, so you can include this list of sites you intend to report the site to for ot abiding by their published return policy.

(they have some grounds the "underwear" issue, though you could clain to have trued them on over something)

Interestingly a whois lookup shows the site is registered to a slightly sketchy looking buenos aires, Argentina address. Lots of sun bathers around there...

That was so expensive, well I think you just need to talk to them in good manner and try to explain why you need to exchange the item you bought.

You need to ring them, emails just don't cut it in a situation like this. Call customer services

I ordered a bikini from an online site that cost me £123. Firstly it arrived late and then when i tried it on it was too small it also wasn't exactly the same as the picture. when i emailed the site to tell them i wanted to exchange it for a bigger size they then told me that the have a policy that states they don't except returns or exchanged on swimwear. i was furious as i did not know this so i went into the site to check it out. it says on the page the bikini is featured on that you can only get an exchange on designer item not a refund. but then when i go on to the returns page it says they cant accept swimwear as a return. it doesn't mention exchange! also i measured myself and the size i selected matched up to me so isn't it there fault that the sizing is not right? and it states on there website if the size is wrong then they will give you a a full refund on your item down to it being there fault basically. where is my rights in all of this? i am furious! can anybody help me?
