you need to know what your rights are as a tenant in the state/commonwealth of VA. you should immediately contact the county court system where you reside and request a copy of the tenant landlord laws. every state has a body of laws that govern tenant landlord disputes/laws so both are on even playing ground. in my state a landlord cannot arbitrarily just say heres a 30 day notice after you pay the bills thats ridiculous. im gonna tell you now most courts will not enforce a 30 day notice AND allow a landlord to accept the rent! if he or she accepted 1 penny towards the rent then hes stuck with you! if you did not pay the rent and hes evicting you for non-payment of rent then he may have a leg to stand on as non payment of rent is 90% of time enough too evict a tenant. did you pay the rent? or did you just pay utilities or some other bills besides the rent. if you cannot resolve your differences force his hand and DO not move out... make him pay the fees and do the paperwork and take it too court. if you explain that you did not violate the lease agreement and you paid the rent and your not in the wrong then he cannot evict you. in the state of ohio where i live no one can evict a tenant at all only a judge or magistrate can evict a tenant! if you cannot work out your differences then make your day or court work for you! you have too figure out if its worth fighting for. i personally stand up for my rights and id fight it to avoid having an eviction ruin my credit or my record. you must do what you think is right for you. but in the meantime call the county courthourse where you live and find out what the laws/rights are for tenants. if you do end up going to court make sure you keep records and you have reciepts! paperwork is key in court as most people lie or fail to tell the truth in court so paperwork serves as evidence. just remember in most states a landlord cannot evict you he can give you all kinds of notices too vacate the property BUT you dont have too abide by them just force his hand too take you to court. you should not pay any more bills or utilities or rent until this issue is resolved. key is too find out what the laws are for you as a tenant and figure out why hes evicting you. if you did not pay the rent you most likely will lose unless you have good reason to do so.... the 35 days thats expired now are meaningless unless a judge says your out.... make em take you too court! if you too cannot work it out i would fight the eviction and avoid damage too credit if you should lose and in the meantime i would find a place to stay as soon as you get the money as who wants too live w someone thats a jerk or not a straight shooter.

No, he can't do this. He can't even serve you a notice. He isn't the landlord. He has no authority to evict anyone at all, including you.
I have been living with my roommate for about 4 months now and was served a 30 day notice 35 days ago we resloved are differences or so I thought. Now he is wanting me to get out now when I just paid some bills and have no other money to move out now. My question is can he do this? Or does he need to serve another 30 day notice considering its been over the 30 days. By the way im in Virginia.
