Yes he has every right to evict you & you cannot extend the eviction process nor do you have any right to. You cannot pay in full & on time you get evicted that's how it works. Your roommate will have an eviction on his record as well. If the total due is not paid then the landlord can sue both of you.

It is unfortunate the roommate screwed you over but that is not the landlord problem. If he is untenable to collect from the roommate you must pay the total due or he can file in court again to garnish your wages. You then have every right to sue the roommate for his part.

Your best bet would be to talk with the landlord to find out if he will give you and extension on your rent. But, since he has already filed eviction charges against you, fat chance.

The judge cannot override your landlord's desire to get rid of you for habitual late or non-payment of rent.

I suggest you start packing. The fact that you may not have found a new place IS NOT going to be your landlord's concern,

You will be evicted, but it would be better for you to get out sooner rather than later. If you actually get evicted (rather than break the lease and pay up), you will have a hard time finding landlords willing to rent to you going forward.

Please re-read the joint and several clause within your lease, you will end up on the hook with your roommate.

Are you opening your ex roommates mail? The landlord can sue you and your roommate or just either one of you! Hopefully your rooommate is just sueing your roommate that moved out!

So I rented a house with my roommate and in 4 months he moved to another place and left me alone. Right now I can't afford paying whole amount and landlord file a case in court with name of my roommate which don't live here anymore. So, please tell me if he can evict me and/or advice me some ways to extend the eviction process. Since I need time to pay full amount or find another place. (Both of our names are in the 1 year lease). And I already received 5 days to respond to the court.?
