You can't sue for damages because you haven't been damaged in any way.
However, I would ask for a refund of the shipping charges once the item shows up.
You need to determine why the game you wanted 2-day shipped never came. If the game is out of stock, then the time frame for shipping has not started - the two-day shipping window starts when it was actually shipped, not when you ordered it.
Call Amazon or the vender and ask where your game is. If it is not in stock, ask when it is expected and then determine whether you still want the expedited shipping or not.

Well 8 days ago i ordered 2 games from amazon, i paid 2 day shipping for one game (it costed extra money) and normal shipping for the other one which was expected to come in 4 to 6 days. So the normal shipping came just yesterday and the 2 day shipping never even came!!! i was so angry because all of my friends were playing the game and i felt left out cause i didnt have the game even though i paid extra for this 2 day shipping!
