Do staff have the right to take tips from customers?

Tell him they DONT belong to the company

ANY tips left on the table belong to the waiter that served that table BY LAW

The ONLY money the company it entitled to is the money presented in the bill (And they may not even be entitled to all that - if the customer is disatified with the meal they are entitled to withhold some of the bill (but not all))

This is CONTRACT LAW- a customer in a cafe enters into a contract between themselves and the cafe. A tip left on the table is NOT part of that contract. Its a gift from the customer to the waiter, and has NOTHING to do with the company. and WHO goves a f//k whether its company policy or not.the - company have NO say in gifts from customer to waiter. If they wish to add that to the "contract" between customer and company than they must explicity make the customer aware that tips belong to the company ie. ITS AN ADDITIONAL CHARGE.

You absolutely have the right to your own tips, and the fact that this person is trying to take them from you and make such a big deal about it shows him to be a crappy manager who is never going to inspire loyalty or excellent service in his staff. Has he ever in worked in this industry before? Surely he should know that it's hard work and tips are the only thing that get you to smile sometimes! And of course, he should know the law, obviously... When a customer gives a tip it is a voluntary donation to the staff as a thank you - it is not for charity or for the business. You could even ask them, if you wanted to be bold and take a stand against your boss, to confim that they are giving you this money. Some places have the rule that all staff have to pool their tips, but then it has to be split equally between everyone - which is why when I pay in my card and the machine says 'would you like to add a gratuity' I always press no and then leave a tip on the table, to ensure that it goes to the person I want it to.

Don't back down - as a student and around Xmas those tips could be worth a hell of a lot to you, so it's not a small thing and you shouldn't let him bully you. Get all the staff to band together on this, as protest do the minimum amount of work and deiberately try to not get tips to show him how much extra you do. An take it further to your higher up boss, area manager or HR.

I am sorry but i strongly feel that your managers policy and logic is faulty and that he and the company should acknowledge that a customer gives a tip irecognitionon of service provided, just a tiny thank you to someone probably far worse off than them self for their help beyond what their job required.

Pooling all tips between the waiting staff is common but purely as a customer i am not sure that i agree with that. If a waiter gives me good service i am giving a tip to him/her - not to the whole staff.

Where I live its called the "labor relations board"

however I suspect that in you area there is a similar function available

if you are a student, there may be counselors available to point you

in the right direction to find your version of the labor relations board.

Hi guys,

I'm a waitor working in the cafe (don't worry I'm a student, I won't be here forever!). Today I had a huge clash with my manager about customers tips. I've been working in this cafe for over four years now. All these time we were never told not to take customers tips. Everyone who works here has always take some/shared now & then including the previous managers. Not a big deal, never been.

This new manager who jointed us about six months ago suddenly went berserk because I took some today (£2 For god sake!). And so the story goes... He said something like, it's part of the policy that all tips customers gave doesn't belong to the staff. They belong to the company and goes straight to the charity box! (Though, there's a charity box separately and most says keep it to ourselves when given)

I know I shouldn't done this, which is not professional but I did it! I've returned! At the time I was just impatient and a little angry. That's only because I see it as such a small particle but he turned it into Mount Everest and so it became an argument. Now he's gonna do all the paper works about it (AKA investigation) and send them to the head office.

(If you wondered if he's one of those... YES! He is! He anal everything! Extremely EXTRA! The atmosphere he created for the work place is never the same anymore. It's not a fun place to work like it used to be. All of us wants to quite. It was so fun when we had the old manager. We're all happy and enjoyed working so much. Not anymore.)

In conclusion, I'm trying to find prove as a backup to whether staff have the right to take tips or not?
