1. If anyone bothers to look at your auction, they'll report you to eBay for shipping price gouging.
2. Most likely no one will bid on your auction.
3. If someone does bid, it's very likely they will refuse to pay or will pay and then file a claim to get their money back.
4. You will be charged final value fees and Paypal fees on $41.
5. You will probably have a case closed against you and may lose both your money and your item.
6. You will get a nasty red donut and your DSRs will be trashed.
eBay put the kibosh on this BS years ago.
I think I read somewhere that eBay will charge a shipping fee as well as sellers where trying to get around paying the final value fee by employing a tactic such as that. eBay will try to do anything they can to get as much money out of you no matter how many ways you try to get around them.
Final value fee is based on the price plus shipping.
It didn't used to be that way, but they changed it because too many sellers started doing exactly what you suggest.

What happens if I list a item for $1 and make the shipping $40 do they count shipping as part of the final price fee? or will I only have to pay the fee equal to the $1
