How do I go about patenting a website idea?

You can, in theory, offer to sell an "idea" as a "trade secret", provided you take the necessary steps to KEEP it secret and your attorney drafts the proper type of license or transfer agreement.

There is no law saying you need a "patent" on something for it to be valuable, nor that having a patent necessarily makes something more valuable.

To be patentable, you would need an actual "invention" and have it described in the necessary detail and file a patent application, which would be examined to determine if it qualifies. For instance, an invention needs to be "new and non-obvious" to someone familiar with every existing invention as of your filing date, including those used in public or disclosed in a publication in any language anywhere in the world, and any equivalents to the above and any obvious modifications or combinations of any of the above. If your invention doesn't pass the examination, your claims will be rejected.

35 USC 101, 102, 103, 112

If you have something patentable, as mentioned by bcnu, then consider this..

To START.. you can actually only spend $65 to file a Provisional Application for Patent, that within one year, you convert to a non-Provisional Patent Application...

Because of nasty lawyers who want to scare you that a patent will cost $10,000 or more I will not give a link because they cause my posts to be deleted. So.. If you want to know EXACTLY how to do this PM me.. If not just read on and see what you can do.

My answers tell you how to take advantage of the Provisional Application for Patent, PPA, and I also have a link to a free NDA that you can use and modify.

Google Provisional Patent Video Course that you can use to go directly to the USPTO's website and file on your own.

The USPTO charges you $65 to file a PPA that gives you "Patent Pending"

Is that cool or what! The answer to your dreams! So Google Provisional Patent Video Course now and you will find the answer!

PM me and I will give you EXACT details so you may benefit and decide for yourself..

Try to get some web developers try it out and see if it works and is of benefit. Once you have proofed the concept you can see about developing it as a business idea. .Really you need to prepare a business case with financial forecasts to get anyone interested, afraid "ideas" by themselves are really just a starting point. Its proving, or at least demonstrating, that its financially worthwhile to develop and invest the necessary resources in doing so.

Google it

An idea, in and of itself, cannot be patented.

I have this really great idea but I do not know how to go about patenting it. I don't have much interest in creating the website but if the idea turns out to be a popular concept then I would be interested in selling the idea.
