YES, IT IS 100% SCAM.
usell is not a scam and the person that said it has probably never used them. They basically work like eBay but in reverse... they bring you the best offer for your electronic devices by comparing different buyers. Perhaps some of the buyers on their site are not be best but uSell itself is certainly not a scam.
They are also a publicly traded company so just because someone had a bad experience using them does not mean that they are a scam.
BTW to get the most for your devices, it is probably best to go directly to the buyers site, because in order to use uSell the buyer must pay a fee which in turn is passed on to you. As an alternative, you can also check out http://www.mailinmobile.com. The site pays top money for used cell phones and other wireless devices.
I sold my iPhone 4s to uSell a few months back and the process was surprisingly quick. From the time I mailed in my phone, it took them just 5 days to send me my check. There was an unexpected mail delay with USPS of a day (I had forgotten about the Veteran's day holiday), but I emailed uSell's support and they got back to me immediately to let me know that my check was still on the way and I should feel free to reach out again if for whatever reason it didn't arrive. They were extremely helpful and I got paid for my old phone as promised.
Hi there! The majority of complaints about uSell date back to transactions that were made prior to June of 2011. The company has an A- BBB rating. All of the customer issues have been resolved and uSell is focused on its new business and providing customers with an easy and secure way of selling their unwanted electronic devices.
Depending on which buyer you choose, payment could be sent anywhere from 2 days to 3 weeks from the time they receive your package. They also offer different payment options, such as check and PayPal. Once you quote a device, click on the "see details" link under the offer to find out the buyer's terms and payment options.
If you have an issue with a current transaction, you are strongly encouraged to contact uSell directly at Support@uSell.com.
I didnt sell an iPhone but another type and they scammed me. I never got paid. They say they sent me emails asking what I wanted to do before they "donated it". I had an independant computer guy go through my spam and search as well. NOT ONE EMAIL. I wrote them ...funny how they couldnt produce any emails either. SCAMMERS!
the fake ppl whos sticking up for usell are prolly usell employees paid to type that ****. its 100% scam. all u gota do is google usell scam. most ppl it takes weeks or over a month for a payment and u dont even get near the money they quoted u and cutoff communication without any chance of gettin ur phone back. ur better offsellin ur old phone online in an ad. usell is not BBB rated AT ALL.

The wise assumption is than people are out to rip you off, even on TV. Advertise on Craigslist.org to locals you can meet in person instead.
The same people appear to operate:

I seen the usell.com commercial so I went on the website and I seen bids for my iPhone.. the highest bid was for $330 and i clicked on it. I signed it up, then they sent me an email saying that they will send me a uSell box in 3-7 days to ship my Sprint iPhone to them... once they receive it, they said they will email me to notify that it is good, then send me my check for $330. Has anyone ever sold phones on this site before? Was it a scam? ..and how long did it take them to send your check after you have received the email?
